FreedomWorks Salutes Virginia Court Decision Declaring Obamacare Unconstitutional

WASHINGTON--(BUSINESS WIRE)--Today, FreedomWorks celebrated a huge victory in the limited government movement after Virginia federal judge Henry Hudson ruled the Obamacare mandate on all Americans to purchase health insurance to be unconstitutional. In finding that the law’s individual mandate “exceeds the constitutional boundaries of congressional power," Judge Henry Hudson’s decision strikes a blow on behalf of limited government and common sense.

FreedomWorks strongly agrees that Congress has no authority to require individuals to buy health insurance under either the interstate commerce clause or the tax clause of the Constitution. In the words of Judge Hudson, "At its core, this dispute is not simply about regulating the business of insurance—or crafting a scheme of universal health insurance coverage—it's about an individual's right to choose to participate."

The Administration’s lawyers tried to argue that not purchasing insurance affects interstate commerce, which Congress may regulate, and that the IRS penalties for noncompliance constitute a permissible use of Congress’s power to tax. Judge Hudson wisely rejected both arguments.

Dean Clancy, Vice President of Health Care Policy at FreedomWorks commented, “This debate goes to the very heart of what America stands for. Is our federal government fundamentally limited, or not? Are we Washington’s masters, or its servants?”

“Today’s decision merely confirms what the tea party has been saying all along: Obamacare should never have been enacted. Thanks to Judge Hudson, Congress has one more powerful reason to reverse the government takeover of health care and adopt a patient-centered approach.”

While Judge Hudson’s ruling leaves most of Obamacare’s 2,801 pages and 159 new bureaucratic entities standing, it effectively removes the heart of Obamacare. Without the mandate, the bill’s core elements can’t work. If this decision stands, it will effectively repeal Obamacare by eliminating the law’s linchpin: the individual mandate.

The stakes are amazingly high. If this decision is ultimately overruled by the Supreme Court, America’s core principles of limited government will effectively dissolve because Washington will be able to order citizens to do literally anything under the guise of regulating interstate commerce. And if the Court also upholds the mandate penalties under the tax power, it will create a powerful new tool for restricting our liberties: the coercive penalty, masquerading as a tax.

This project is a petition drive to place the Health Care Freedom Amendment on the November 2011 ballot. This amendment to the State of Ohio's Constitution would assert Ohio's states rights under the 10th Amendment of the U.S. Constitution.

Stated simply this amendment says that no Ohioan can be compelled to participate in a health care plan and that no Ohioan can be penalized in any way for not participating in a health care plan.

We are having an impact this election season. Both Congressman John Boehner and Congresswoman Jean Schmidt have signed the petition! Currently we are at over 280,000 signatures and clmbing!

We are organizing groups of petition circulators to walk the uncovered precincts in Butler county every Saturday. We need your help, please volunteer to join us by contacting Ann Becker at ann@zoomtown.com. 

I want you to think about something for a moment, please. The historical ramafications of this people's initiative are mind boggling! Getting it on the ballot would be history making. First, this is not like the other state challenges to the Health Care bill, this would be the people of Ohio amending our state constitution. Second, what this amendment does is protect our fundamental righs, not challenge the federal government in court. They would be bringing a challenge against us. Third, this court challenge would probably set new precedents in case law for states rights under the Tenth Amendment of the US Constitution! All because you went out in your neighborhood, and collected signatures.

Let that sink in for a moment. I hope that I have been able to convey to you why getting this issue on the ballot so that the people of Ohio can decide is so critically important. Let's not waste this opportunity to make a statement pass us by. We the people need to say we have had enough!

BAD MEDICINE A GUIDE TO HR3590's COSTS & CONSEQUENCES

For better or worse, President Obama’s health
care reform bill is now law. The Patient Protection and Affordable Care Act represents the most significant transformation of the American healthcare system since Medicare and Medicaid. It will fundamentally change nearly every aspect of health care, from insurance to the final delivery of care.

The length and complexity of the legislation, combined with a debate that often generated more heat than light, has led to massive confusion about the law’s likely impact. But, it is now possible to analyze what is and is not in it, what

it likely will and will not do.



Here are the signs you can print out and glue to a piece of that foam board you can buy at Wal-Mart and you will have created a "stick sign". Put the slogan on top, put the "Sign The Petition Here" sign underneath it and you are done.

When I have used these signs, half the time I don't even have to ask people to sign, they come to me. They work very well. Having said that, don't be afraid, ask every person you see to sign the petitions, do it on the way out. As a matter of fact, give them the slate card going in, if they accept it, you tell them that they can sign the petitions after they vote.
